Supreme Court Case Law
This is a language-neutral seminar
This is an interactive, two-hour, language-neutral seminar about Supreme Court case law.
We will discuss two Supreme Court cases Missouri v. McNeely (2013) and Birchfield v. North Dakota (2016) (which includes three consolidated cases: Birchfield, Bernard and Beylund) and their impact on DUI laws. These cases address the issue of when a citizen must comply with an officer's order to give a blood sample or breath test under the implied consent requirement. We will learn the legal requirements and discuss the interactions from a defense viewpoint.
